Powers of Attorney

A Power of Attorney is a legal document appointing a person or persons (your attorney or attorneys) to manage your financial affairs and assets on your behalf. It may be limited in relation to the circumstances and acts which it enables the attorney to do or unlimited. If it is unlimited it will enable the attorney to do anything which you could do, whether with or without your knowledge and consent.
Decisions your attorney makes on your behalf are legally binding.

It is essential that you have proper advice and assistance in giving a power of attorney, as it is a powerful document.

There are two types of Power of Attorney - General and Enduring.

An Enduring Power of Attorney will remain in force in the event that you lose the mental capacity to make financial decisions. We are experienced in advising clients wishing to appoint an attorney.

Guardianship

An Enduring Guardian can be appointed to make lifestyle and health related decisions on your behalf should you lose capacity. This appointment is necessary if you wish to be confident as to who will exercise these functions for you when necessary.

Lifestyle and Health related decisions include where you should live and what medical treatment and personal services you should receive and the delegation of decisions to refuse medical care on your behalf where circumstances indicate this option and the refusal of care may result in your death.

Where a person has lost the capacity to make lifestyle and health related decisions and has not appointed an Enduring Guardian we can assist by preparing an application to the Guardianship Tribunal for the appointment of a guardian and other required management orders.
